These Terms constitute a legally binding agreement between you (“User,” “you,” “your”) and Hadar Real Estate, governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates.

• AI-powered real estate inquiry services via website chat, voice calls, and WhatsApp
• Property search and matching based on client preferences

• Facilitation of property viewings and site visits
• Transaction support for buying, selling, and renting properties in Dubai

3. AI-Powered Services

Our services utilize artificial intelligence technology. By using our AI-powered features, you acknowledge and agree that:

• AI responses are generated algorithmically and may not always be perfectly accurate
• Property information, prices, availability, and market data provided by AI are for informational purposes only and should be verified with a human agent before making decisions
• AI-generated content does not constitute professional real estate advice, legal advice, financial advice, or investment advice
• Voice interactions may be recorded for quality assurance and service improvement
• Chat conversations are logged and may be reviewed to improve AI performance
• You may request human assistance at any point during an AI interaction

4. User Obligations

When using our Services, you agree to:

• Provide accurate, current, and complete information
• Not misrepresent your identity, financial capacity, or intentions
• Not use the Services for any unlawful purpose or in violation of UAE law
• Not attempt to interfere with, compromise, or disrupt our AI systems or infrastructure
• Not use automated bots, scrapers, or similar technology to access the Services
• Not use the Services to harass, abuse, or harm others
• Comply with all applicable UAE laws, including anti-money laundering regulations

5. Property Information Disclaimer

All property listings, prices, floor plans, renders, payment plans, and market information provided through our Services are:

• Subject to change without notice
• Based on information provided by developers, sellers, and public sources
• Not guaranteed for accuracy, completeness, or timeliness
• Provided for informational purposes only and do not constitute an offer

Official pricing, availability, and terms are confirmed only through formal documentation such as booking forms, Sales and Purchase Agreements (SPAs), and developer confirmations.

6. Commission and Fees

Our brokerage services are primarily commission-based. Standard industry commission rates apply. Commission is typically paid by the seller or developer. Any fees payable by you will be clearly communicated and agreed upon in writing before any obligation arises.

7. Intellectual Property

All content on our website and Services — including text, graphics, logos, AI algorithms, software, and design — is the property of Hadar Real Estate or its licensors and is protected by UAE and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by UAE law:

• We provide our Services on an “as is” and “as available” basis without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services
• We are not liable for decisions made based on AI-generated information
• Our total liability for any claim shall not exceed the fees paid by you to us in the 12 months preceding the claim
• We are not liable for any loss arising from third-party services, including property developers, banks, or government entities

9. Indemnification

You agree to indemnify and hold harmless Hadar Real Estate, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, breach of these Terms, or violation of any applicable law.

10. Dispute Resolution

Any dispute arising from these Terms or your use of the Services shall be:

• First attempted to be resolved through good-faith negotiation within 30 days
• If unresolved, submitted to mediation under the rules of the Dubai International Arbitration Centre (DIAC)
• If mediation fails, submitted to binding arbitration under DIAC rules
• The seat of arbitration shall be Dubai, UAE
• The language of proceedings shall be English

Nothing in this clause prevents either party from seeking interim or injunctive relief from the Courts of Dubai.

11. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, for any reason, including violation of these Terms. Upon termination, all rights granted to you under these Terms shall immediately cease.

12. Modifications

We may modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms. Material changes will be notified via email or website notice.

Where modifications involve material changes to how your personal data is processed (e.g., new categories of data collected, new purposes of processing, or new third-party data sharing), we will seek your active re-consent before implementing such changes. Continued use of the Services does not constitute consent to material data processing changes; explicit opt-in is required.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates.
